3am Reminder or 4th Amendment Violation?
Terrence Brown MN We Are C.H.A.N.G.E June 21, 2008 Troy Molde was woken up by Lakeville police in Minnesota at 3 am. on Thursday. Lakeville police stopped in front of his residence when they noticed the garage door was open. The officers rang the doorbell and knocked on the front door but when
this didn't work they felt that this was just cause to enter his garage and investigate further. According to the Pioneer Press, the officers told Molde his garage door was open, the TV was on, keys to his truck were left in the ignition and the door to his house was ajar. Police said the intrusion
was justified because the officers' initial door knocks went unanswered. Police went inside to check if anything was wrong, Sgt. Jim Puncochar said. The day after the incident Troy spoke about his ordeal on the Chris Baker radio show. He talks about what he did prior to the incident "...my car wa
s in my garage with my keys in the ignition but I've always done that so I don't lose my key. Normally I shut my garage but I just happened to forget to shut it that night." He also disputes the some of the claims made by police and media "...the article says that the door was ajar, it wasn't, it h
as a spring on it so it wouldn't stay ajar and so the door was closed." He goes on to say "...they actually came out again last night for damage control and the Sargent said that the story was they looked in the window and saw a child sleeping on the floor which wasn't the case. It was never mention
ed when they were there and it was a hardwood floor ...when the sergeant came out last time he apologized, well not really apologized but he said heres our story it kind of pissed me off when the story changed." Troy feels that his constitutional rights were violated and under the fourth amendment
which guards against unreasonable searches and seizures he may be right. The police retort that they were there to prevent a crime. The mainstream media has been covering this story since it broke but at the same time they've spinning it with the "what if" scenarios verses the basic questions they
should be asking. Is it constitutional for a officer to walk into my home without probable cause? Do I have rights and were they violated? Police officers swore an oath to uphold the constitution and at what point does prevention become violation. http://mnchange.org/3-am-reminder-or-4th-amendment

So many Americans ... ( 4 months ago by Acrinimiril)
So many Americans are naieve to their rights.
If the police would have found something they considered even possibly illegal during their home invasion, or any 'possible' evidence of abuse, then it would have been confiscated and this person would have been taken to jail. Even if he had comitted no crime, or the evidence was false, he would
have had to work his way out of jail and disprove it in court. Read the 4th Amendment, it's in my profile - this is a clear violation.

And, I salute him for doing something about it rather than just saying "oh well" and moving on. That sort of complacency and apathy is what has resulted in the whittling away of our rights over time by the government.
The very fact that some people think nothing wrong happened is proof that people are now ignorant of the Constitution and current attacks on individual liberties.

I would be pissed at being woke up to find flash lighs in my face. But were they really acting like Gestapo? Hardly.
You would have made the exact same video if they decided to walk on by and some burgler was inside your house and had your family at gunpoint while they ransacked the place.
You would then be whining why they "didnt show some common sence when the garage door was open in the midle of the night." Need to take the tin foil hat off. This is what? the first time this has happend?

Oh noess!!!11!!11!1!one!!11eleven!1 I was woken up for (as stated) 5 minutes or less by officers who had a concern for the safety of my family and I. Get a life. People like the idiot above are one of the reasons crime rates are so high. Leave the garage opened, with the vehicle inside, unlocked and the keys in the ignition. Good idea. Also, leave your young kids and thier friends alone downstairs with nothing seperating from the dangers outside but a door. Great parenting. Awesome job.
Just walking in to ... ( 4 months ago by dilbertgeg)
Just walking in to your bedroom, unannounced, without being phoned, at 3am? That's perfectly OK?
Troy didn't mention "gestapo". Gestapo was a secret political police. We have that too now in America, by Executive Decree. This happens less often in wealthy suburbs, random invasions on "suspicion", abetted by Drug Laws that created Federal Agencies and new Federal powers, justified by Harry A
nslinger's reading of 1930s Hollywood Tabloid articles about marijuana mayhem.

Sure glad the 4 kids under 7 didn't start a fire, or play on 911 - since they were afraid to wake up the Dad. And yeah, the video you make after the fact is really credible. **rollseyes** You screwed up dude - man up and accept responsibility.
My point is had ... ( 4 months ago by fgp123)
My point is had there actually been a real problem and they decided to 'respect' your privacy and walk on by despite there being a few anomalies that could point to a break in or some other kind of problem. And you or your family were subjected to harm or worse, you would be making the same video asking why they didn't do their job and protect and serve. I hardly think the police actually get off breaking into peoples homes for the fun of it. It just smells of tin foil hat syndrome.
I agree that this ... ( 4 months ago by Eli3333333)
I agree that this fellow really was not the brightest bulb in the pack. Left his garage open, keys in the truck, door unlocked and kids laying there unprotected at all. Not cool. That being said, he was ABSOLUTELY right. If I woke up to someone shining a flashlight at me they would run a high risk of getting shot.
If I somehow ... ( 4 months ago by Eli3333333)
If I somehow managed to get the sense about me to NOT fire the weapon because I (at 3AM) some how understood them screaming "police!", then I would immediately would have escorted them to the door with my weapon and video camera in my hand. After they were out of my house, I would talk to them of their concerns, while I was calling 911 to get their supervisor on site ASAP. This is CRAZY wrong.

Donald Scott was shot at home
According to Ventura County District Attorney Bradbury, the purpose of the raid was to seize Scott's ranch under asset forfeiture laws and then divide proceeds with participating agencies, such as National Park Service, which had put Scott's ranch on a list of property it would one day like to acq

I do not need the police to bother me to keep me safe. I'll call when I need them. Over reaching of the police is our greatest concern in a free nation. 'Give me liberty or give me death', not 'give me safety or give me death.'
Yeah, this is f'd ... ( 3 months ago by djjimi)
Yeah, this is f'd up. Police NEVER have the right to enter a home without a warrant even if they suspect there is a non-violent crime in progress. They CAN enter if they have reason to suspect someone is in danger, but nothing about this suggests that they had any reason to believe such a thing.
Make an example of them... sue the bastards.
The police never ... ( 3 months ago by 1freedomfighta)
The police never admit when they are wrong! Who is going to protect us from the police? The ACLU needs to be informed every time an illegal action is committed by the police. I hate the fact that some of our taxes pays these people that violate our rights. I commend you for speaking out against them. If more innocent people would speak out, then maybe there would be a change. Good luck in your efforts and remember, lawyers are part of that same system..Go to the ACLU.
The police never ... ( 3 months ago by 1freedomfighta)
The police never man up when they are wrong. Police screw up just like everyone else only they have a badge and gun that say's I'm a cop, I'm not capable of screwing up, I'm just protecting my ass while I violate your rights.

Those police should be glad they didn't get shot. I'm not going to assume the police are wandering around my house at 3 am to tell me my garage door is open.

I have to say the worst thing they did was to awake you with the flashlights in the face. Had that happened in my home, being a combat veteran, I would have come up shooting fearing they were bad guys. It was a stupid move by ill trained officers.

WeAreChange did an excellent job creating and posting this video. I read on the INFOWARS website about this. The Corporate Media made it sound like the Home Owner was all doped up, had the engine running and left the kids running wild in the street. None of it was true. We are now living in Martial Law. I was walking on the street at 11PM and I was questioned, searched and held hostage in the back of a car until I I.D. myself, all without probable cause and no reason. Warrantless stop+search.

Dude, I'd be very upset if that happened in my house. The police clearly did not have a warrant and that just ticks me off. They were not trying to protect you. They were only testing their power. Just to be on the safe side, keep your house locked up at night from now on. I don't know if you really did leave your keys in the car or not, but that's a really bad idea, especially when you have kids, and especially especially when they have friends over. Good luck to you in the future. :)

From Ohio here(Youngstown,Ohio). So many people in this country have NO clue to our Constitutional rights. if you look on youtube, under (struthers police) you'll see that i have been violated for speaking the truth about corrupt activity here. Our local media refuses to tell public the truth. I have used a video camera catching bad cops and one stopped me and accused me of videoing kids, didn't happen. He is going to get a ruling whether its legal.I was NOT videoing kids nor is it illegal.
