Wow! This was awesome however batman is not film noir. The main character may have flaws but he is an indestructible superhero and that kinda disqualifies it...

it's not necasserily the characters in the film, but the way is it shot, whats on set and how it is edited. for example, there is alot of use of smoke in batman, for instance when his parents are shot, it is in monochrome and you can see a figure with a gun wavering in the dark smoke arising from the gutter. The reason Batman doesn't come off as film noir is becuase it was originally a comic, so it has all the elements of an action and adventure. Tim Burton is the only reason batman is so good.

If you are only talking about the look of the film then sure, batman can be considered noir. However, limiting noir to a "look" is cutting the genre short. While not a rule, film noir usually has a main character that "descends into hell" figuratively of course.
The look of the film can greatly vary, Chinatown is considered noir...

He was doing it for the effect. Film Noir was primarily active in the 1950's when EVERYONE 12 and up was puffing there brains out. So incidentily most of the characters in Film Noir movies, smoked.
